A Guide for Foreign Nationals Married to a Thai National
For foreign nationals who are legally married to a Thai national, the Non-Immigrant O Visa (Based on Marriage) provides a lawful pathway to reside in Thailand on a long-term basis without the need for frequent border runs or short-term visa extensions.
What is the Marriage Visa?
The Non-Immigrant O Visa (Based on Marriage) is issued to foreign nationals who are legally married to a Thai national. It is initially granted for a period of 90 days and may be extended annually at the Immigration Bureau in Thailand.
Eligibility Requirements
To qualify, applicants must satisfy the following conditions:
- Legally married to a Thai national under Thai law
- Hold a valid passport with a remaining validity of at least 18 months
- Meet the prescribed financial requirements
- Have no criminal record in Thailand
Financial Requirements
Applicants must demonstrate sufficient financial means through one of the following methods:
Bank Deposit A minimum of THB 400,000 must be deposited in a Thai bank account from an overseas source and maintained for at least 2 months prior to the visa application.
Monthly Income A monthly income of at least THB 40,000, supported by a letter of income verification issued and officially certified by the applicant’s embassy.
Combined Method A combination of bank deposit and monthly income totalling THB 400,000 per year, with supporting documentation as required.
Important: The bank deposit must originate from an overseas source and be held in a Thai bank account in the applicant’s name. For income-based applications, the income verification letter must be officially certified by the relevant embassy before submission.
Application Procedure
From outside Thailand: Applications may be submitted through two channels:
- In person at the Royal Thai Embassy or Consulate in the applicant’s country of residence
- Online via the Thailand e-Visa system at thaievisa.go.th available in participating countries
Note: The availability of the e-Visa system varies by country. Applicants are advised to check whether their country of residence is covered by the Thailand e-Visa service before proceeding with an online application. Supporting documents must still be uploaded in the prescribed format.
The visa is initially granted for 90 days and may be extended for 1 year upon arrival in Thailand.
From within Thailand: Applicants already present in Thailand may apply for a visa change of type or annual extension at the Phuket Immigration Office or the relevant Provincial Immigration Office.
Annual Extension
The marriage visa must be renewed annually. At each renewal, applicants must submit complete documentation and provide evidence that the marriage remains legally valid. Immigration officers may request supporting evidence of the genuine marital relationship including joint photographs, evidence of cohabitation, or correspondence between the spouses.
90-Day Reporting
All visa holders residing in Thailand are required to report their address to the Immigration Bureau every 90 days. This may be done:
- In person at the nearest Immigration Office
- By post
- Online via the official Immigration Bureau website
Failure to report within the prescribed period may result in a fine of THB 2,000 per occurrence.
Important Considerations
- Employment The marriage visa does not confer the right to work in Thailand. A separate Work Permit and appropriate work visa are required for any form of employment.
- Re-entry Permit If the visa holder intends to travel outside Thailand and return during the validity period, a Re-entry Permit must be obtained from the Immigration Bureau before departure. Failure to do so will result in the visa being cancelled upon exit.
- Divorce In the event that the marriage is dissolved by divorce, the marriage visa ceases to be valid. The visa holder will be required to change to an alternative visa category or depart Thailand.

What happens to the marriage visa if my Thai spouse passes away?
The visa remains valid until its expiry date. However, upon renewal, the holder will generally be required to transition to an alternative visa category. It is strongly advisable to seek legal or immigration advice specific to the circumstances.
Can I apply for a marriage visa without leaving Thailand?
In certain circumstances, yes. Applicants already in Thailand on an eligible visa type may apply for a change of visa category at the Immigration Office without the need to depart Thailand.
Can my children reside in Thailand under my marriage visa?
